1. Introduction and Acceptance of These Terms

These Terms of Use (“Terms”) govern your use of the Photoeval website at https://www.photoeval.com and its related services (the “Service”), provided by Photoeval (“we”, “us”; see our legal notice).

By creating an Account or using the Service, you accept these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle your personal data. Paid features are also covered by Section 11, which you confirm before each purchase.

2. Definitions and Interpretation

In these Terms:

  • “Account” means your personal account on the Service.
  • “AI Analysis” means the automated evaluation of a Photo by our AI, and “AI Feedback” means any score or comment it produces.
  • “Community Feedback” means ratings and comments that Users give on a Photo. They are those Users’ personal opinions, not ours.
  • “Consumer” means a User acting outside their trade, business or profession.
  • “Paid Feature” means any feature you pay for, shown as “Full results” in the Service. Each payment is a one-time payment for one Photo, not a subscription.
  • “Photo” means any image you upload, with its attached information.
  • “Photoeval Parties” means us and anyone who works with us or on our behalf on the Service, including our founders, contractors and moderators.
  • “Rater” means a User who gives Community Feedback on another User’s Photo.
  • “Results” means the AI Feedback, Community Feedback and other output you receive about a Photo.
  • “Test” means submitting a Photo to other Users for Community Feedback.
  • “User” or “you” means anyone who uses the Service.
  • “User Content” means anything you upload or provide through the Service, including Photos, Community Feedback, your first name and reports.

“Including” introduces examples and does not limit what comes before it.

3. Eligibility

You must be at least 18 (or the age of majority where you live, if higher), legally able to enter into a contract, and not prohibited by law from using the Service. You may have only one Account, and you may not share it or create one for someone else. By using the Service, you confirm that this is true and that the age you give us is accurate.

We may check your age at any time but are not obliged to. Our automated age estimation may block a Photo if a person in it may be under 18. It can be wrong, and we are not liable for blocking a Photo in good faith. We may also ask for proof of age and suspend your Account until you provide it.

We do not claim the Service is lawful in every country. You are responsible for complying with your local laws, and we may block access in any country. If we reasonably believe you do not meet these requirements or gave false information, we may suspend or close your Account and delete your User Content, without notice where the law allows.

4. Accounts

You must give accurate information when you create your Account, and choose a first name that does not impersonate anyone, include contact details or links, or offend. We may refuse an Account or first name for a legitimate reason, such as suspected fraud, a previous ban or a legal requirement, and change any first name that breaks these rules.

Keep your login details confidential. You are responsible for all activity under your Account, unless it results from our fault or a breach you did not cause. Tell us at contact@photoeval.com if you suspect unauthorized access. We are not liable for losses caused by your failure to keep your login details secure.

We may send you service messages by email or in the Service, including changes to these Terms and decisions about your Account. A message sent to your registered email counts as received. You can close your Account at any time in your settings. When your Account is closed, by you or by us, you lose access to your Photos and Results, and your personal data is handled as described in our Privacy Policy. Ratings you gave others may remain in anonymized form. Your Account cannot be transferred.

5. How the Service Works

Photoeval lets you upload Photos for a free AI Analysis, submit them to Tests for Community Feedback, and rate other Users’ Photos. You may evaluate Photos of yourself for any personal or professional purpose. Photoeval is not a dating service and does not let Users contact each other.

AI Feedback is generated automatically, without human review. It is an estimate that may be inaccurate or inconsistent and may reflect the limitations of the data and methods used to build our systems. It assesses a Photo rather than you as a person, and it is not professional advice of any kind.

Community Feedback reflects the opinions of other Users, who are not our employees or representatives and whom we do not verify. It may be negative or inconsistent. Our quality checks may give some ratings less weight or exclude them. Information about Raters shown in Results, such as gender, age or country, is self-declared and unverified.

Results are for information only. We do not promise any outcome, such as more matches or opportunities, and any decision you make based on Results is your own responsibility.

6. Your Photos: Rules for Uploading

You are solely responsible for what you upload. Photos must clearly show you, as an adult, and no one else. Photos with no clear main subject, such as group photos, are rejected automatically. Detection can be wrong, and if another person still appears in an accepted Photo, they must be an adult who agreed to it or must not be recognizable.

You must not upload anything that:

  • shows or appears to show a person under 18;
  • contains nudity or sexual content;
  • shows violence or illegal activity;
  • contains hateful or discriminatory content;
  • shows someone other than you or impersonates anyone, including through AI-generated or altered images;
  • contains contact details, links, addresses or other identifying information;
  • contains advertising or spam; or
  • infringes anyone’s rights or is otherwise unlawful or harmful.

By uploading a Photo, you confirm that it complies with this Section and that you have the right to upload it. Photos submitted to a Test are shown to other Users. Copying them is prohibited, but we cannot fully prevent screen captures. We may remove metadata such as location data. We may refuse, remove or restrict any Photo, and suspend or close your Account if you break this Section (see Sections 10 and 16).

7. License You Give to Photoeval

You keep ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to store, copy, adapt, analyze (including through AI Analysis, face detection and age estimation), display in Tests and Results, and moderate your Photos, in order to operate, secure and improve the Service. This license ends when you delete the Photo or close your Account, except for backups kept for a limited time, copies needed for legal reasons or as evidence, and anonymous statistics that do not include the Photo.

You also grant us a worldwide, royalty-free, perpetual and irrevocable license to use and display the ratings and comments you give on other Users’ Photos, including after you close your Account. Our service providers may process your User Content on our behalf.

We do not use your Photos (the images) to train AI models, and we do not sell or share them for others’ AI training. We will not use your Photos in advertising without your explicit consent.

8. Rating Others: Community Rules

Rating is voluntary and unpaid. Rating more may move your Photos up the rating queue, and paid Tests always get priority. This priority has no monetary value, guarantees no number of ratings or timeframe, and may change at any time.

Ratings must be honest and about the Photo. Comments must not insult, harass, sexualize or discriminate against anyone, or include personal information, links or advertising. You must not copy, save or share other Users’ Photos, try to identify or contact anyone, use fake accounts or bots, trade ratings, or rate your own Photos.

If the owner of a Photo you rate unlocks its full Results, they see your rating and comment, with your first name, age, country and the last Photo you uploaded.

You are solely responsible for the feedback you give. We may filter, reweight or remove any rating or comment, and restrict, suspend or close your Account if you break this Section (see Sections 10 and 16).

9. Prohibited Uses

You may use the Service only for your own Photos, for personal or professional purposes, and not on behalf of others or as part of a business without our written permission. You must not, or help anyone else to:

  • use the Service unlawfully or fraudulently, or impersonate anyone;
  • access another User’s Account, or get around a ban or restriction;
  • scrape or extract data from the Service by automated means;
  • reverse engineer the Service or its scoring methods, except as the law allows;
  • use the Service or its Results to build a competing product or train AI;
  • bypass any security, age check, content filter or paywall;
  • probe for vulnerabilities, overload the Service or upload malicious code;
  • resell access to the Service;
  • collect other Users’ personal information;
  • submit false reports or payment disputes; or
  • harm the Service, us or other Users in any other way.

We reserve all text and data mining rights over the Service. If you find a security weakness, report it to contact@photoeval.com rather than exploit it. If you break this Section, we may close your Account immediately, report you to the authorities and claim damages.

10. Content Moderation and Reporting

We use automated tools (face detection, age estimation and comment filtering) and human review to enforce these Terms. Automated tools can make mistakes. We are not obliged to monitor content but may act at any time, and content that may involve a minor is handled first.

Anyone can report content or a User through the report buttons or at contact@photoeval.com. We may remove, blur or hide content, reweight ratings, limit features, or suspend or close Accounts. Where required by law, we will explain our decision. You can contest it within 3 months at contact@photoeval.com, and a person will review it.

11. Paid Features and Payments

A paid Test is a one-time purchase for one Photo. It gives you your full Results and a total of 30 ratings, including free ratings already received. It is not a subscription. AI Analysis is free.

Prices are shown before payment and include applicable taxes. Price changes do not affect past purchases. Payments are processed by our third-party payment provider, and we do not store your card details. Except where required by law, payments are non-refundable.

Ratings come from other Users, so we cannot guarantee timing, and any timeframe shown is an estimate. We aim to complete your Test within a reasonable time, and in any event within the period required by applicable law. Removed ratings do not count toward the 30, and time when your Test is paused, removed from the queue or suspended for a breach does not count toward that period.

To the extent permitted by law, no refund is due if your Test is not completed because you deleted the Photo or closed your Account, or because we removed it for a breach.

Your full Results are digital content supplied as soon as your payment is confirmed. At checkout, you ask for them to be supplied immediately and acknowledge that you thereby lose any right to withdraw from the purchase. Please contact us before disputing a charge with your bank. We may suspend your Account during a dispute and close it if the dispute was unjustified.

12. Intellectual Property

The Service, including our software, AI, scoring methods, databases, design and the Photoeval name and logo, belongs to us and is protected by intellectual property laws. We give you a limited, personal, non-exclusive, non-transferable and revocable right to use it under these Terms, and we reserve all rights not expressly granted to you.

You may share your own Results for personal purposes, but you must not alter them or suggest that we endorse you. You may not use our name or logo without permission. We may freely use any feedback or suggestions you send us.

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PHOTOEVAL PARTIES PROVIDE THE SERVICE, INCLUDING AI ANALYSIS, COMMUNITY FEEDBACK AND RESULTS, “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted or error-free, that Results will be accurate, or that your content will be preserved, so save anything you want to keep. We are not responsible for third-party providers or for the conduct of other Users. If you are a Consumer in the European Union, nothing in this Section limits your legal guarantee of conformity or other mandatory consumer rights.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PHOTOEVAL PARTIES ARE NOT LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL LOSS, LOSS OF PROFITS, DATA OR REPUTATION, EMOTIONAL DISTRESS OR PUNITIVE DAMAGES; FOR USER CONTENT OR THE CONDUCT OF ANY USER; FOR MODERATION DECISIONS TAKEN IN GOOD FAITH; OR FOR EVENTS BEYOND OUR REASONABLE CONTROL. THEIR TOTAL COMBINED LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND 50 US DOLLARS. Nothing in this Section limits liability that cannot be limited by law.

15. Indemnity

To the extent permitted by law, you will indemnify the Photoeval Parties against third-party claims, and related losses and reasonable legal fees, caused by your User Content or your breach of these Terms, the law or anyone’s rights. We may control the defense of any such claim, and you may not settle it without our consent.

16. Suspension and Termination

You can close your Account at any time. We may suspend, restrict or close your Account without warning if you break these Terms, if the law requires it, if your use puts others at risk, or if you abuse payments. Where required by law, we will tell you why. You then lose access to your Account and Results.

We may stop offering the Service at any time with reasonable notice. Provisions that by their nature should continue, such as those on licenses, payments, liability, indemnity and disputes, survive the closure of your Account.

17. Changes to These Terms and the Service

We may update these Terms for legal, operational, security or Service reasons. We will notify you of important changes before they take effect. If you keep using the Service, you accept them; if you do not agree, you can close your Account. Changes do not affect paid Tests already bought.

We may change or remove any feature of the Service, including how Results are presented. A paid Test you have bought will still include its ratings and access to its Results.

The Service was entirely rebuilt and relaunched in November 2026 as a new service, with new features, scoring methods and Results. If you had an account on the previous version of Photoeval, we may have carried over your account information and your latest Photo, which is analyzed again and submitted to a new Test. Ratings, scores, Results and rating history from the previous version are not carried over, and neither are any paid features, subscriptions or other advantages bought or earned there. Any Paid Feature we grant on a carried-over Photo is a goodwill gesture. No refund or compensation is due for what is not carried over, to the extent permitted by law. By using the Service with a carried-over account, you accept these Terms.

18. Governing Law and Disputes

These Terms are governed by French law. If you are a Consumer in the European Union, you also keep the mandatory protections of your country and may bring proceedings in its courts. Please contact us first at contact@photoeval.com with any complaint. If we cannot resolve it, you may use any out-of-court dispute resolution or court remedy available to you under the law of your country. Subject to mandatory law, disputes go to the courts of Paris, France, on an individual basis only and not as part of any class or group action.

19. Miscellaneous

These Terms, with any terms shown at checkout, are our entire agreement. We may transfer them, for example if the Service is taken over or sold; you may not. If any part is invalid, the rest still applies, and not enforcing a term immediately does not waive it. The English version prevails over any translation, to the extent permitted by law.
